These Terms of Use (“Terms”) govern your access to and use of the Villa Nautica Maldives information and enquiry website located at villanautica.reservationsandsales.com (the “Website”), which is operated by Maldives Sales and Reservations Agent Pvt Ltd (“we”, “us”, “our”).

By browsing this Website, submitting an enquiry or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

We are an independent Maldives reservations and booking management company. We are not owned, operated or controlled by Villa Nautica or Villa Resorts, and this is not the official Villa Nautica website. Resort names, logos and images remain the property of their respective owners.

2. Scope of Our Service

The Website is designed to provide information about Villa Nautica Maldives and to allow you to request personalised quotes for stays at the resort. When you submit an enquiry:

• We collect your travel preferences (dates, villa type, meal plan, number of guests, budget and similar details) and contact information.
• We use this information to check availability, prepare package options, and liaise with Villa Nautica, Villa Resorts and authorised wholesale partners.
• Where you choose to proceed, we help coordinate and confirm bookings under the terms of the relevant resort or partner contract.

The Website itself does not take payment online. Final booking terms, including deposit, cancellation rules, amendments and inclusions, will be communicated to you as part of your quote and/or booking confirmation.

3. Independent Agent & No Guarantee of Availability

We act as an independent reservations agent and do not guarantee that any particular villa, rate, promotion or service will be available on your preferred dates. All quotes and options are subject to:

• Resort and supplier availability at the time of booking;
• Applicable blackout dates, minimum stay rules and other conditions;
• Resort decisions on upgrades, special offers, and complimentary add-ons.

We are not responsible if a resort or partner withdraws or changes an offer, closes certain facilities, or modifies services at short notice, provided we have acted with reasonable care in relaying information available to us at the time.

4. Eligibility and Use of the Website

By using this Website, you confirm that:

• You are at least 18 years old and have legal capacity to enter into binding agreements; and
• You will use the Website only for genuine travel enquiries or bookings for yourself or others with their authority.

You agree not to:

• Use the Website for fraudulent, speculative or misleading enquiries;
• Interfere with or disrupt the operation of the Website or underlying systems;
• Attempt to gain unauthorised access to our servers or data; or

Before you confirm a booking, we recommend carefully reviewing the final quote, inclusions and booking conditions we send you. The resort’s own terms and policies will also apply to your stay.

6. Prices, Currency and Taxes

Package prices and nightly rates shown in quotes are typically stated in United States Dollars (USD) or as otherwise indicated. Unless we clearly state otherwise, prices:

• Are per booking or per villa (not per person) for the specified number of guests and nights;
• May include or exclude government taxes, service charges and green taxes – this will be clearly stated in your quote;
• Are subject to change until your booking is confirmed and any required payment is received by us or the resort/partner.

Currency conversions (if shown) are for guidance only. Your bank, payment provider or the resort may apply its own exchange rate and fees.

7. Bookings, Payments, Amendments and Cancellations

Once you decide to proceed with a Villa Nautica booking, we will provide you with the applicable payment terms and cancellation policy for that specific offer. These are usually determined by:

• Villa Resorts (as the resort operator); and/or
• Our contracted wholesale partners issuing the booking.

You are responsible for carefully reading those terms before making payment. In general:

• Deposits and/or full prepayment may be required by a specified date;
• Cancellation or change fees may apply, including potential full charges for late cancellations or “no-show”;
• Amendments (such as date or villa-type changes) are subject to availability and may result in different pricing.

All payments must be made using methods we confirm to you (for example bank transfer or payment link). We reserve the right to cancel provisional bookings if payment is not received by the stated deadline.

8. Travel Documents and Requirements

You are responsible for ensuring that you and any other travellers in your booking meet all:

• Passport and visa requirements;
• Health, vaccination or testing requirements; and
• Airline, immigration and local government regulations for travel to the Maldives and any transit countries.

We do not accept liability if you are unable to travel or use your booking because you fail to comply with such requirements.

9. Liability and Disclaimers

To the fullest extent permitted by law, we exclude all warranties, representations or guarantees (express or implied) relating to this Website, its content, or any services arranged on your behalf, except as expressly set out in these Terms.

In particular:

• We are not liable for acts, omissions or service quality of Villa Nautica, Villa Resorts, transport providers or any third-party suppliers;
• We are not responsible for losses arising from events outside our reasonable control, such as weather, flight disruptions, government restrictions, health emergencies or resort operational decisions;
• We are not liable for indirect or consequential losses, loss of enjoyment, loss of opportunity or loss of profit.

Our total liability to you, whether in contract, tort (including negligence) or otherwise, in connection with any booking or use of this Website, will be limited to the amount of commission or service fee we have actually received from that booking (if any), except where a higher limit is required by applicable law.

10. Intellectual Property

The design and layout of this Website, and content we create (including our text descriptions and layouts), are protected by copyright and other intellectual property rights.

Resort names, images and logos shown on this Website are used with permission or based on publicly available marketing materials and remain the property of Villa Nautica, Villa Resorts or their respective owners.

You may view, download and print content from the Website for personal, non-commercial use related to planning your stay. Any other use, including copying, modifying, distributing or re-publishing content for commercial purposes, requires our prior written consent and, where applicable, the consent of the relevant resort or rights holder.
